1. Agreement to the Terms
By accessing or using Transhipp, you agree to these Terms of Service and acknowledge the Privacy Policy. If you do not agree, do not use the service.
These Terms apply to public website visitors, registered customers, transportation-provider users, and anyone acting through an account or on behalf of an organization.
2. About Transhipp
Transhipp is an online marketplace and booking platform that helps customers create shipment requests, receive and compare quotes, communicate with transportation providers, provide booking details, and receive shipment updates.
Transportation services are performed by independent transportation providers in Transhipp's private provider network. Unless a particular service expressly says otherwise, Transhipp does not itself take possession of, load, carry, store, or deliver the customer's shipment.
3. Eligibility and Accounts
Transhipp is not directed to children under 13. A person arranging a paid transportation transaction must have the legal capacity to do so under applicable law. If you use Transhipp for a business or another person, you represent that you are authorized to act for them.
You must provide accurate, current account information, safeguard your credentials, and promptly notify Transhipp if you suspect unauthorized access. You are responsible for activity conducted through your account to the extent permitted by law.
4. Shipment Requests
Customers must provide complete and accurate information needed to understand and quote a shipment, including:
- Pickup and delivery locations, access conditions, requested timing, and contact details.
- The type, quantity, dimensions, weight, condition, operability, packaging, and handling needs of the vehicle, cargo, animal, furniture, equipment, or other item.
- Any hazardous, regulated, oversized, high-value, live-animal, permit, equipment, documentation, or special-care requirements.
Material inaccuracies or omissions may change a quote, delay service, make equipment unsuitable, or cause a provider to decline or modify the transportation arrangement.
5. Quotes
Quotes are submitted through participating transportation providers. Customers should review the provider, amount, estimated timing, messages, and any stated conditions before accepting a quote.
Provider and shipment availability can change. A displayed quote does not guarantee that the provider, equipment, route, price, or timing will remain available indefinitely. Customers should communicate special requirements before booking.
6. Transportation Providers
Transportation providers are responsible for the services they agree to perform, including their equipment, personnel, operating authority where applicable, licenses, permits, legal compliance, insurance appropriate to their operations, shipment handling, and delivery obligations.
Transhipp may display provider-supplied information and platform badges. A badge or profile does not eliminate the customer's responsibility to review a provider or constitute an unconditional guarantee of performance, authority, insurance coverage, delivery time, or cargo condition.
7. Booking and Payment
The customer booking flow is: accept a quote, provide booking details, pay the Booking Deposit Due Today through checkout, and receive booking confirmation after successful payment capture.
Checkout may show the Total Transport Price, the Booking Deposit Due Today, and the Remaining Balance to Provider. PayPal processes the booking deposit. The remaining transportation balance is handled directly with the transportation provider according to the booking arrangement.
A booking requiring payment is not finalized until payment is successfully confirmed. A payment may be declined, fail, be reversed, or require review. Customers authorize the displayed booking deposit when they approve checkout.
8. Cancellations, Refunds and Changes
Customers and providers should contact Transhipp promptly if they need to cancel or materially change a booking. Refund eligibility depends on the circumstances, booking status, payment status, services already performed, provider arrangements, and applicable law.
A payment dispute, reversal, or chargeback does not automatically resolve any separate obligation between a customer and transportation provider. Transhipp may request information from the parties when reviewing a cancellation, change, or payment issue.
9. Pickup, Transit and Delivery
Pickup and delivery dates or times may be estimates unless expressly confirmed as guaranteed in the booking. Weather, traffic, mechanical issues, legal restrictions, route conditions, and customer or provider availability can affect transportation.
Users must provide safe, lawful, and reasonably accessible pickup and delivery locations, disclose access limitations, and ensure authorized people are available when required.
10. Prohibited and Regulated Shipments
You may not use Transhipp to arrange transportation prohibited by law. Specialized, hazardous, regulated, oversized, high-value, live-animal, or otherwise restricted transportation must be accurately disclosed and may require a qualified provider, special documents, permits, equipment, or insurance.
A provider may decline a shipment it cannot lawfully or safely transport. Transhipp may restrict or remove requests that present legal, safety, fraud, or platform-integrity concerns.
11. Communications
Customers and providers may communicate through Transhipp. Users may also receive transactional communications about quotes, unread messages, bookings, shipment status, support, and account or security matters.
You are responsible for keeping contact information current and for communicating respectfully and accurately. Transactional messages are part of operating requested services and are not marketing newsletters.
12. Reviews and User Content
You must submit truthful reviews, shipment information, messages, photos, profile details, and other content. Fabricated reviews, impersonation, abusive or unlawful material, and misleading shipment or quote information are prohibited.
You retain the rights you hold in your content. You grant Transhipp a limited, non-exclusive right to host, process, reproduce, format, and display that content as reasonably necessary to operate, secure, support, and improve the service. Providers may not fabricate customer reviews.
13. Acceptable Use
You may not use Transhipp to commit fraud, abuse accounts, impersonate others, manipulate quotes or reviews, scrape the service without authorization, distribute malware, attack or overload systems, evade security controls, access data without permission, or engage in unlawful activity.
You may not interfere with another user's use of the platform or use information obtained through Transhipp for an unrelated unlawful or abusive purpose.
14. Third-Party Services
Transhipp relies on third-party technology and service providers for functions such as hosting, database and authentication services, address suggestions, email delivery, and payment processing. PayPal processes electronic checkout.
Third-party services may have their own terms and privacy policies. Transhipp does not receive or store complete payment-card numbers or card security codes through the current PayPal checkout integration.
15. Intellectual Property
The Transhipp name, branding, website design, platform software, and original platform content are owned by Transhipp or its licensors and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of customer, provider, or other third-party content. You may not copy, modify, distribute, or exploit Transhipp's protected materials except as permitted by law or with written authorization.
16. Availability and Changes to the Service
Transhipp may update, maintain, add, remove, suspend, or change platform functionality. The service may occasionally be unavailable because of maintenance, security work, provider outages, technical failures, or events outside reasonable control.
We aim to operate the service reliably but do not promise uninterrupted or error-free availability.
17. Disclaimers
Transhipp provides a marketplace and booking platform. To the extent permitted by law, the platform is provided on an "as available" basis. Quotes, provider profiles, estimated dates, messages, and user-provided information may contain errors or change over time.
Transhipp does not guarantee that every requested shipment will receive a quote, that a particular provider will accept or complete a job, or that transportation will occur by an estimated time. Nothing in these Terms excludes warranties or rights that applicable law does not allow parties to exclude.
18. Limitation of Liability
To the extent permitted by applicable law, Transhipp is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the platform, independent provider conduct, delays, or unavailable services.
Any liability that cannot lawfully be excluded or limited remains subject to applicable law. These Terms do not limit liability for matters that cannot legally be limited.
19. Indemnification
To the extent permitted by law, you agree to be responsible for reasonable claims, losses, and costs arising from your unlawful use of Transhipp, materially false shipment or account information, content that violates another person's rights, or material violation of these Terms.
Transhipp will provide reasonable notice of a covered claim and an opportunity to participate in its defense where appropriate.
20. Suspension and Termination
Transhipp may restrict, suspend, or terminate access when reasonably necessary to address suspected fraud, security concerns, abuse, legal or compliance obligations, risk to users, or violations of these Terms.
Users may stop using the service at any time. Provisions that by their nature should continue after termination, including payment obligations, ownership, disclaimers, and limitations, will continue as permitted by law.
21. Changes to These Terms
Transhipp may update these Terms as the platform, business, or legal requirements change. Updated Terms will be published on this page and the Last Updated date will be revised.
Your continued use after updated Terms become effective means you accept them, except where applicable law requires another form of notice or consent.
22. Governing Law and Disputes
These Terms and disputes relating to Transhipp are governed by applicable law. Before beginning formal proceedings, users are encouraged to contact Transhipp so the parties can try to understand and resolve the concern informally.
Nothing in this section removes rights, remedies, or access to courts or agencies that cannot be waived under applicable law.
